KO menar att konsumentavtal som f\u00f6rl\u00e4ngs automatiskt n\u00e4r avtalsperioden g\u00e5r ut \u00e4r osk\u00e4liga. D\u00e4rf\u00f6r tar nu KO ett av bolagen som anv\u00e4nder metoden, Canal Digital, till Marknadsdomstolen. En f\u00e4llande dom kan f\u00e5 stor betydelse f\u00f6r flera branscher, skriver Konsumentverket i ett pressmeddelande<\/a>.<\/p>\n

Konsumentombudsmannen, KO, anser att Canal Digitals avtalsvillkor f\u00f6r digital-tv-abonnemang inneh\u00e5ller s\u00e5 kallad negativ avtalsbindning. Det inneb\u00e4r att konsumenten blir bunden av ytterligare en abonnemangsperiod om han eller hon inte s\u00e4ger ifr\u00e5n. Vid negativ avtalsbindning ligger ansvaret f\u00f6r att vara vaksam p\u00e5 konsumenten. Det \u00e4r konsumenten som m\u00e5ste agera f\u00f6r att ta sig ur ett avtal. Det r\u00e4cker inte att bindningstiden g\u00e5r ut f\u00f6r att ett abonnemang ska sluta g\u00e4lla.<\/p>\n

Negativ avtalsbindning av konsumentavtal f\u00f6rekommer i flera olika branscher. KO menar att detta bara \u00e4r till\u00e5tet i undantagsfall. Digital-tv \u00e4r inte ett s\u00e5dant undantagsfall enligt KO som d\u00e4rf\u00f6r kr\u00e4ver att Marknadsdomstolen f\u00f6rbjuder Canal Digitals automatiska f\u00f6rl\u00e4ngning av digital-tv-abonnemang.<\/p>\n

– Automatisk f\u00f6rl\u00e4ngning binder upp konsumenter som inte agerar. Det gynnar s\u00e4ljaren p\u00e5 konsumentens bekostnadt, s\u00e4ger Agneta Broberg, st\u00e4llf\u00f6retr\u00e4dande Konsumentombudsman.<\/p>\n

I domen kan man l\u00e4sa att att Canal Digitals avtal inte handlar om negativ marknadsf\u00f6ring d\u00e4rf\u00f6r att: ”Genom de aktuella avtalen har Canal Digital och kunden uttryckligen kommit \u00f6verens om vad som ska g\u00e4lla om upps\u00e4gning inte sker, dvs. om b\u00e5da parter f\u00f6rh\u00e5ller sig passiva”.<\/p>\n
