En majoritet av de n\u00e4tbutiker som Konsumentverket granskat f\u00f6ljer inte lagen om \u00e5ngerr\u00e4tt. Krav p\u00e5 att originalf\u00f6rpackningen ska vara obruten eller extrakostnader f\u00f6r att l\u00e4mna tillbaka datorer \u00e4r tv\u00e5 exempel d\u00e4r kunden luras, enligt en artikel<\/a> i SvD.<\/p>\n

Upprinnelsen \u00e4r tydligen att SvD noterat att Siba ans\u00e5g att \u00e5ngerr\u00e4tten inte g\u00e4llde varor som grillar, mixar och rakapparater. N\u00e5got som Siba numera \u00e4ndrat p\u00e5, efter det att tidningen tagit upp saken.<\/p>\n

Det finns undantag i lagen, som i det h\u00e4r fallet g\u00e4ller distans- och hemf\u00f6rs\u00e4ljningslagen. Det g\u00e4ller varor som inte kan l\u00e4mnas tillbaka i ”v\u00e4sentligt of\u00f6r\u00e4ndrat skick”. Enligt Konsumentverket handlar det om matvaror eller hygienartiklar, knappast grillar.<\/p>\n

Ett av de f\u00f6retag Konsumentverket granskade i februari \u00e4r Expert, skriver SvD. Vid myndighetens granskning kr\u00e4vde f\u00f6retaget en \u00e5terst\u00e4llningsavgift om datorer som k\u00f6pts i deras n\u00e4tbutik \u00e5terl\u00e4mnades i en \u00f6ppnad f\u00f6rpackning. ”I strid med lagen”, konstaterar Konsumentverket.<\/p>\n

Lagen \u00e4r ist\u00e4llet tydlig med att kunden ska f\u00e5 unders\u00f6ka varan – och d\u00e4rmed m\u00e5ste f\u00f6retag r\u00e4kna med att k\u00f6paren startar datorn. Kostnaden f\u00f6r att \u00e5terst\u00e4lla datorn ska f\u00f6retaget sj\u00e4lvt st\u00e5 f\u00f6r, enligt tidningen. Det finn s f\u00f6retag som tar ut en avgift f\u00f6r det.<\/p>\n

Jag tycker det \u00e4r m\u00e4rkligt att s\u00e5 h\u00e4r stora kedjor inte har lagstiftningen klar f\u00f6r sig. Fr\u00e5gan \u00e4r om det \u00e4r fr\u00e5ga om ett medvetet trixande, eller ren okunnighet.<\/p>\n

Jag har tidigare bloggat om<\/a> n\u00e4thandel som har felaktig eller obefintlig information om \u00e5ngerr\u00e4tte, i det fallet g\u00e4llde det barnkl\u00e4der. Det \u00e4r tydligt att fler branschewr borde l\u00e4ra sig att informera om \u00e5ngerr\u00e4tten vid n\u00e4thandel, p\u00e5 ett korrekt s\u00e4tt.<\/p>\n
