Men enligt KO s\u00e5 \u00e4r f\u00f6rs\u00e4kringarna osk\u00e4liga f\u00f6r konsumenterna p\u00e5 tv\u00e5 punkter. Dels \u00e4r den f\u00f6rskottsbetalade f\u00f6rs\u00e4kringstiden upp till fem \u00e5r, dels betalas ingen premie tillbaka vid en totalskada, skriver KoV i ett pressmeddelande<\/a>.<\/p>\n

Enligt f\u00f6rs\u00e4kringsavtalslagen f\u00e5r inte avtalstiden f\u00f6r en f\u00f6rs\u00e4kring \u00f6verstiga ett \u00e5r, om det inte finns s\u00e4rskilda sk\u00e4l. Syftet med det \u00e4r att konsumenten ska ha m\u00f6jlighet att aktivt v\u00e4lja om hon vill f\u00f6rnya f\u00f6rs\u00e4kringen eller inte. Att Moderna F\u00f6rs\u00e4kringar erbjuder sina kunder att s\u00e4ga upp avtalet varje \u00e5r \u00e4r inte godtagbart, menar KO.<\/p>\n

F\u00f6rs\u00e4kringsavtalslagen har ocks\u00e5 klara regler n\u00e4r det g\u00e4ller \u00e5terbetalning av premie. Enligt lagen s\u00e5 har konsumenten r\u00e4tt att f\u00e5 tillbaka premien om f\u00f6rs\u00e4kringen upph\u00f6r i f\u00f6rtid, oavsett anledning.<\/p>\n

Moderna F\u00f6rs\u00e4kringars avtalsvillkor inneb\u00e4r att om konsumenten till exempel tecknat en fem\u00e5rig produktf\u00f6rs\u00e4kring f\u00f6r en kamera och kameran m\u00e5ste ers\u00e4ttas med en ny efter ett halv\u00e5r s\u00e5 upph\u00f6r f\u00f6rs\u00e4kringen och n\u00e5gon premie \u00e5terbetalas inte. F\u00f6rs\u00e4kringen \u00f6verg\u00e5r heller inte till ers\u00e4ttningskameran, enligt pressmeddelandet.<\/p>\n

KO anser att Moderna F\u00f6rs\u00e4kringars avtalsvillkor \u00e4r osk\u00e4liga och vill nu att Marknadsdomstolen pr\u00f6var saken.<\/p>\n
